Website Terms (Use, Sale, Delivery and Returns)

These Terms of Use (“Terms”) govern your use of the website ap9engineering.com (the “Site”) and all purchases made from AP9 Engineering OÜ via the Site.

All complaints, questions, and notices relating to these Website Terms or to any order should be directed to info@ap9engineering.com.

2. Definitions

  • Consumer” means a natural person acting for purposes outside their trade/business.
  • Business Customer” / „B2Bmeans any buyer acting in the course of trade/business.
  • Goods“/“Products“ means items sold on the Site.
  • Made-to-order” / „Custom item“ means produced after ordering (custom production / small-batch made for the buyer).

3. Products

3.1. Product nature. AP9 designs, manufactures and sells limited-run newly manufactured reproduction parts mainly for classic Saab 900 (model years 1980–1993). These are new products created independently by AP9 to replicate components that are no longer available from the original manufacturer or through any official supply chain. Typical categories include rubber components such as spring pads/bushings and composite parts such as brake dust shields and arch liners.

3.2. Handcrafted/small-batch nature. Products are produced in small batches using artisanal methods and may show minor cosmetic marks (e.g., small scratches, tool traces, minor surface imperfections, minor batch-to-batch colour variation). These are normal characteristics of handcrafted goods and do not constitute non-conformity/defect, and are not grounds for return/refund/claim unless the issue materially prevents the Product from functioning as described on the product page.

3.3. Fitment & adjustments. Classic car restoration parts may require typical fitting/adjustment (e.g., trimming, alignment, torque checks) depending on vehicle condition, prior repairs, corrosion, and installation method. Unless expressly stated otherwise, we do not guarantee “bolt-on” fitment on every vehicle.

3.4. Intended use; no road-use approval. Products are designed and sold to assist in the restoration, maintenance, and preservation of the vehicles. No Product has been type-approved, homologated, certified, or otherwise approved for road use in any jurisdiction. Whether a restored vehicle (with AP9 parts installed) may be lawfully used on public roads (including any local inspection, roadworthiness, or modification-approval requirements) is entirely the buyer’s responsibility. AP9 makes no representation that any Product satisfies any road safety standard or roadworthiness criterion in any country.

4. Regulatory status

4.1. No certification / approvals (unlessstated). Unless the product page explicitly states otherwise in writing, Products are sold without any representation of:

  • vehicle type-approval / roadworthiness approval in any jurisdiction,
  • “E-mark”, UNECE approval, TÜV (Technischer Überwachungsverein) approval, or similar,
  • CE marking or conformity assessment,
  • compliance with any specific motor vehicle safety standard.

4.2. Buyer is responsible for compliance and suitability. You are solely responsible for:

  • verifying legal compliance in the country where the vehicle is registered/used and where you import/install the Product,
  • confirming compatibility with your vehicle and intended use,
  • ensuring safe installation, inspection, maintenance and use.

4.3. No affiliation. “Saab” and related marks are the property of their respective owners. AP9 is not affiliated with or endorsed by Saab or any OEM.

4.4. The above does not affect AP9’s mandatory obligations under applicable product safety legislation (including Regulation (EU) 2023/988 on General Product Safety) or under mandatory product liability law.

5. Stock Items vs Made-to-Order Items

5.1. Stock items are available for immediate checkout when shown as “In stock”.

5.2. Made-to-order items are produced after ordering (and may have lead times stated on the product page). Made-to-order items may be excluded from the EU/EEA consumer right of withdrawal (see Section 10.2).

6. Orders, Contract Formation, and Errors

6.1. Order process. You place an order via the Site checkout (or, for certain made-to-order items, via an order request/confirmation flow described on the product page).

6.2. Contractformation:

  • Stockitems: The sales contract is formed between you and AP9 Engineering OÜ when we send and order confirmation email after successful payment.
  • Made-to-order/custom items: The sales contract is formed between you and AP9 Engineering OÜ when we explicitly confirm acceptance for production.

6.3. Price/description errors. We may refuse/cancel an order (e.g., pricing/stock error, suspected fraud, shipping restrictions). If payment has been taken for a cancelled order, we will refund without undue delay.

7. Prices, Taxes, Customs

7.1. Currency. Prices are shown in EUR unless stated otherwise.

7.2. VAT (EU sales). VAT handling depends on destination and customer status (consumer vs business) and is calculated at checkout in accordance with applicable tax rules.

7.3. Non-EU orders (incl. USA, Switzerland). Prices typically exclude destination-country import VAT/sales tax, customs duties, brokerage/clearance fees. These are paid by the customer to the relevant authorities/carrier.

8. Payment

8.1. Payment methods available are shown at checkout (e.g., card/bank link, PayPal, Apple Pay, Google Pay). Payment processing is handled by the payment provider; AP9 Engineering does not store full card details.

9. Delivery

9.1. Carrier. We ship using the carrier option displayed at checkout (currently Omniva and partner networks). Dispatch time is stated on the product page or in the order confirmation.

9.2. Dispatch times:

  • Stock items: usually dispatched within [X] business days after payment confirmation.
  • Made-to-order: dispatched after production; estimated lead time is indicated on the product page and/or in the order confirmation.

9.3. Delivery address. You are responsible for providing a complete and correct address and contact details. If a shipment is returned to us due to incorrect address/unclaimed parcel, we may charge re-shipping costs or refund excluding shipping, depending on the situation.

9.4. Delivery times are estimates. Transit times are estimates and may vary due to customs, peak seasons, weather, strikes, or carrier delays.

9.5. Shipping costs. Shipping cost is shown at checkout and depends on destination/weight/parcel size.

9.6. Customs and import. For shipments outside the EU, you may be contacted by the carrier/customs to provide information and/or to pay import charges. Failure/refusal to pay import charges may result in return/destruction/storage fees, which are your responsibility (to the extent allowed by mandatory law).

9.7. Risk of loss / damaged parcels:

  • Consumers: risk passes when you (or a person indicated by you) physically receive the goods (subject to mandatory consumer law).
  • B2B: risk passes at dispatch/hand-over to the carrier unless mandatory law provides otherwise. If the parcel arrives visibly damaged, document it immediately (photos) and contact us without delay.

9.7A. International ShipmentsIncoterms and Risk.

  • All shipments outside Estonia are made on FCA (FreeCarrier), Incoterms® 2020 terms, unless otherwise agreed in writing.
  • Risk of loss, damage, or destruction of the goods passes to the buyer (or, in a consumer transaction, to the carrier acting on the buyer’s behalf) at the moment the goods are handed over to the first carrier at our dispatch point.
  • From that moment onwards, the buyer solely bears:
  1. all freight, handling, and transport-related costs;
  2. all customs duties, import taxes, VAT, excise duties, and any other fiscal charges or levies imposed by the destination country or any transit country (including, but not limited to, shipments to other EU Member States, the United States, Switzerland, or any other country);
  3. all risks and costs arising from packaging damage, loss, delay, or non-delivery during transit;
  4. any return, storage, or destruction fees arising from the buyer’s failure to accept delivery or to comply with customs requirements.
  • We do not accept liability for damage to goods or packaging that occurs after handover to the carrier, or for any additional charges imposed at the destination. If you are a consumer, mandatory statutory rights under applicable consumer protection law remain unaffected.

9.8. Transit damageprocedure. If your parcel arrives visibly damaged, you should:

  1. document damage with photos,
  2. keep all packaging, and
  3. contact us as soon as possible at info@ap9engineering.com with your order number.

We will work with you to file a carrier claim where applicable.

10. Returns & Withdrawal

This section describes AP9’s returns process. Mandatory consumer rights (EU) apply where applicable.

10.1 EU/EEA Consumer right of withdrawal (14 days) – Stock items only

If you are a Consumer and you buy eligible stock items online, you may withdraw from the purchase within 14 calendar days from the day you receive the goods, without giving a reason.

To withdraw, email info@ap9engineering.com with a clear statement (order number + items + “I withdraw from the contract”).

Return shipping costs: You bear all direct costs of returning the goods to us (including carrier fees, packaging, and any applicable customs duties on the return shipment). We do not provide prepaid return labels unless required by mandatory law or unless we expressly agree otherwise in writing.

Condition / diminished value: You may handle the goods only as you would in a physical store to assess them. If you use/install the Product beyond what is necessary to assess it, we may reduce the refund to reflect diminished value (as allowed by law).

10.2 No withdrawal for made-to-order / custom items. The 14-day withdrawal right does not apply to Products made to your specifications or clearly made-to-order/custom (where mandatory law allows this exclusion).

10.3 Return procedure (AP9 process)

  • Contact: info@ap9engineering.com
  • Include: order number, returned items, reason (optional), photos (recommended).
  • We provide: return address and basic instructions.
  • You ship the return with tracking and secure packaging.

Return shipping costs are borne solely by you (whether Consumer or Business), unless the return is due to our error (wrong item, missing item, or confirmed transit damage under clause 10.6). This includes any carrier fees, packaging costs, customs duties, and handling charges related to the return shipment.

10.4 Refund timing and method. If a refund is due, we will issue it using the same payment method, unless agreed otherwise, within 14 calendar days after we receive the returned goods (or proof of return, whichever is earlier).

10.5 Non-returnable situations (process-based). We may refuse a return/refund (to the extent allowed by mandatory law) if:

  • the Product has been installed, modified, damaged, contaminated (oil/grease), or otherwise used beyond inspection;
  • the return is outside the permitted period;
  • the item is made-to-order/custom and no defect exists.

10.6 Wrong item / shipping error / transit damage. If you received the wrong item, missing item, or goods damaged in transit:

  • contact us promptly (include photos of packaging and item),
  • we will instruct next steps and, where applicable, arrange replacement/refund according to mandatory law.

10.7. B2B Returns

If you are purchasing as a Business, the statutory 14-day right of withdrawal does not apply. Returns are accepted only at our sole discretion and subject to prior written agreement.

Where a return is agreed:

  1. All return shipping costs (including carrier fees, packaging, insurance, customs duties, and any other transport-related charges) are borne entirely by you;
  2. A restocking fee may apply, as notified to you in writing at the time of approval;
  3. Goods must be returned in original, unused, uninstalled, and uncontaminated condition with all original packaging;
  4. We reserve the right to refuse the return or reduce any refund if the goods are returned in a condition other than as described above.

Returns of made-to-order or custom items are not accepted unless the item is defective.

11. Consumer legal conformity / defects (EU)

11.1. For EU consumers, mandatory consumer sales law gives you rights if goods are defective/non-conforming. Nothing in these Terms removes those mandatory rights.


 11.2. However, the handcrafted characteristics described in Section 3.2 are disclosed in advance and are not treated as defects unless they materially affect function as described.

11.3. Claims: notify us promptly after discovering the issue; include order number and photos.

11.4. Under EU law (Directive 2019/771/EU), consumers have a minimum two-year statutory conformity guarantee from the date of delivery. AP9 does not limit this period.

12. Safety, Installation & Use Warnings

12.1. Professional installation required for suspension and brake-adjacent components. Vehicle parts can affect safety-critical systems. For suspension components (including spring pads and bushings) and brake-adjacent parts, installation must be performed by a qualified mechanic or professional automotive workshop — this is a safety requirement, not merely a recommendation. For other components, professional installation is strongly recommended. Improper installation of suspension or brake-adjacent components may result in loss of vehicle control, serious injury, or death. AP9 accepts no liability for damage, injury, or loss arising from improper installation or installation by an unqualified person.

12.2. Inspection and maintenance. You must inspect Products before and after installation and periodically thereafter. Do not use a Product that appears damaged, deformed, cracked, excessively worn, or otherwise unsafe.

12.3. No safety assurances. We do not represent that Products will prevent accidents or that they are “as safe as OEM (Original Equipment Manufacturer)”.

13. Disclaimer of Warranties

13.1. General. To the maximum extent permitted by law, Products are provided without warranties except those that cannot be excluded under mandatory law.

13.2. EU consumers. This warranty disclaimer does not limit mandatory consumer rights (legal guarantee / conformity rights).

13.3. B2B and nonEU buyers (including USA). To the fullest extent permitted by law, and except as explicitly stated in writing by AP9:

  • Products are provided “AS IS” and “AS AVAILABLE”;
  • we disclaim any implied warranties including merchantability and fitness for a particular purpose;
  • we do not warrant uninterrupted availability of the Site or that Products will meet every specific regulatory requirement in your jurisdiction.

14. Limitation of Liability

14.1. No indirect damages. To the maximum extent permitted by law, AP9 is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of revenue, loss of business, loss of goodwill, downtime costs, or third-party claims.

14.2. Liability cap. To the maximum extent permitted by law, AP9’s total liability arising out of or related to a Product/order is limited to the amount you paid to AP9 for the specific Product(s) giving rise to the claim.

14.3. Personal injury and mandatory liability excluded from cap. The liability cap does not apply to: (a) claims for death or personal injury; (b) claims under mandatory product liability law (including EU Directive 85/374/EEC, EU Directive 2024/2853/EU, or equivalent mandatory national or state law); or (c) any other liability that cannot be excluded or limited under applicable mandatory law. To the extent any applicable law prohibits such limitation, AP9’s liability for such claims shall be determined by that applicable law.

14.4. No exclusion where prohibited. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law (e.g., certain liabilities for personal injury caused by negligence, fraud, or mandatory product liability regimes).

15. Indemnity

15.1. B2B indemnity. If you are a Business customer, you agree to indemnify and hold AP9 harmless from claims, losses, fines, penalties, and expenses (including reasonable legal fees) arising from:

  • your installation/use/resale of Products,
  • your failure to comply with laws/regulations in your market,
  • your customer claims and third-party claims related to your use/resale (except to the extent caused by AP9’s willful misconduct or non-excludable mandatory liability).

15.2. Consumers. For Consumers, this clause applies only to the extent permitted by mandatory law.

16. Intellectual Property; Site Use

16.1. All content on the Site (including product photos, technical drawings, text, logos, and the AP9 Engineering name and branding) is owned by or licensed to AP9 Engineering OÜ and may not be copied or used commercially without permission.

16.2. You must not misuse the Site (attempt hacking, scraping, interfering with checkout, etc.).

17. Privacy & Cookies

17.1. Personal data processing is described in our Privacy Policy and Cookie Policy, available on the Site.

18. Governing Law, Consumer Protection, and Dispute Resolution

18.1. Governing law. These Terms are governed by the laws of the Republic of Estonia.

18.2. US buyers. If you are located in the United States, mandatory federal and state laws may apply to your transaction regardless of the governing law clause above. Nothing in these Terms is intended to waive, limit, or override any rights you may have under applicable US federal or state law, including applicable product liability law. The choice of Estonian law does not affect your rights under US mandatory law.

18.3. Consumers. If you are a consumer residing in another country, mandatory consumer protection rules of your country may apply, and you may have the right to bring claims in your home courts where required by law.

18.4. B2B jurisdiction. For B2B disputes, courts of Estonia (Harju County Court) have exclusive jurisdiction unless agreed otherwise.

19. Changes, Severability

19.1. We may update these Terms from time to time by publishing a new version on the Site.

19.2. If any provision is found unenforceable, the remaining provisions remain in effect.
